Terms of Service

These terms govern access to and use of the anydefect service. The contracting supplier's legal name, registered address, and any negotiated terms must be stated in your checkout confirmation or Order Form. An executed Order Form takes precedence if it conflicts with these online terms.

1. Accounts and access

You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Keep your contact information accurate and up to date.

2. Acceptable use

You may not misuse the service or attempt to access it using a method other than the interface and instructions we provide. You agree not to interfere with the service, other users, or security controls.

3. Subscriptions and billing

Paid plans, seat limits, and billing terms are defined in your order form or subscription plan. Taxes may apply. Failure to pay may result in suspension or termination.

4. Data and privacy

Our handling of personal data is described in our Privacy Notice. You remain responsible for the content and data you submit to the service.

Where we process personal data on your behalf, the signed Data Processing Addendum and its documented instructions apply. Security findings and reports may contain personal or confidential data; you are responsible for assigning appropriate access and retention.

5. Intellectual property

We retain ownership of the service, software, and documentation. You retain ownership of your data. Except as expressly granted, no rights are transferred.

6. Service outputs and assurance limits

Results reflect the targets, credentials, permissions, engines, signatures, and point-in-time data available to the service. The service can produce false positives, false negatives, or incomplete coverage. Reports and framework mappings support review; they are not a certification, audit opinion, legal advice, or guarantee that a system is secure or compliant.

7. Warranty disclaimer

The service is provided "as is" and "as available." We disclaim all warranties to the maximum extent permitted by law.

8. Limitation of liability

Subject to any liability terms in an Order Form and to the maximum extent permitted by law, the anydefect supplier will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data.

9. Termination

You may stop using the service at any time. We may suspend or terminate access for violations of these terms or to protect the service.

10. Changes

We may update these terms periodically. Continued use of the service after changes become effective constitutes acceptance of the updated terms where permitted by law. Material changes will be presented for acceptance when required.

11. Authorized scanning

By connecting a cloud environment, Microsoft 365 tenant, domain, repository, or any other target to anydefect, you represent and warrant that you are the owner of, or are explicitly authorized in writing by the owner to perform security assessments on, the target infrastructure. anydefect scans only the targets you configure and initiates no scan without your explicit instruction.

You accept sole responsibility for ensuring that scans are permitted under applicable law, your organization's policies, and any third-party agreements (including cloud provider terms of service). The anydefect supplier accepts no liability for unauthorized scanning resulting from credentials or targets you supply. Misuse of the scanning capability to target infrastructure you do not own or are not authorized to assess constitutes a material breach of these terms and will result in immediate account termination.

12. Confidentiality and security

Each party must protect the other party's confidential information using reasonable care and use it only to perform or receive the service. This does not cover information that is public without breach, already lawfully known, independently developed, or lawfully received from another source. Required disclosures must be limited and notified where legally permitted.

13. Third-party services

Connectors, cloud providers, repositories, scanners, and other third-party services remain subject to their own terms. You authorize the service to access them only within the permissions you configure.

14. Enterprise terms

Service levels, support commitments, security schedules, data residency, governing law, liability caps, and any indemnities apply only when expressly stated in an executed Order Form or agreement. Marketing pages and product labels do not create those commitments.
